These Terms of Use ("Terms") govern your use of the Orlando Home Pros website (the "Site"). The Site is operated by EMC314 LLC, a Florida limited liability company located in Port Orange, Florida ("we," "us," or "our"). By using the Site or submitting a request, you agree to these Terms. If you do not agree, do not use the Site.

1. Referral and matching service only

Orlando Home Pros is a referral and matching service only. We share homeowner requests with independent third-party service providers ("Providers"). We are not a contractor, and we do not perform, supervise, direct, inspect, or guarantee any work. Providers are independent businesses, not our employees, agents, or partners.

2. No vetting or warranty about providers

We do not conduct background checks, license verification, insurance verification, or other screening of Providers on your behalf. We make no representation or warranty about any Provider's licensing, insurance, qualifications, quality of work, pricing, timeliness, honesty, or conduct. Any information about a Provider is supplied by the Provider or third parties and is not verified by us.

3. Your responsibility

You are solely responsible for evaluating, vetting, selecting, and hiring any Provider, including verifying licenses, insurance, references, and permits before any work begins. Any estimate, contract, payment, or other agreement is solely between you and the Provider. We are not a party to any such agreement and are not responsible for its performance.

4. No guarantee of a match

We do not guarantee that your request will be matched with a Provider, that a Provider will contact you, or that any Provider will be available.

5. Your submissions

You agree to provide accurate information and that you are authorized to request service at the property involved. You consent to be contacted as described in the request form and our Privacy Policy.

6. Disclaimer of warranties

THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EMC314 LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY PROPERTY DAMAGE, PERSONAL INJURY, LOSS, OR CLAIM ARISING FROM OR RELATED TO ANY PROVIDER, ANY WORK PERFORMED OR NOT PERFORMED, OR YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR OUR SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless EMC314 LLC and its members, managers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your dealings with any Provider, or your violation of these Terms.

9. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in or serving Orange County, Florida, and you consent to the jurisdiction of those courts.

10. Changes

We may update these Terms at any time by posting a revised version on this page with a new "Last updated" date. Your continued use of the Site means you accept the updated Terms.
